2. Purposes and legal bases of processing

We process your personal data for the following purposes:

a) Handling enquiries and correspondence — when you contact us through the contact form, by e-mail or by telephone, we process your data in order to reply. Legal basis: Article 6(1)(f) GDPR (legitimate interest of the controller).

b) Conclusion and performance of a contract — when we begin working together, we process the data necessary to provide legal services. Legal basis: Article 6(1)(b) GDPR (performance of a contract).

c) Compliance with legal obligations — arising from tax and accounting rules and from the regulations governing the practice of a patent attorney. Legal basis: Article 6(1)(c) GDPR.

d) Marketing and information about our services — solely with your consent, where given. Legal basis: Article 6(1)(a) GDPR.

3. Scope of data collected

We collect only the data necessary for the purpose for which it was provided:

— identification data: name and surname, company name, — contact data: e-mail address, telephone number, — data provided voluntarily in the content of a message or in the course of providing services, — technical data: IP address, cookies (details in section 8).

4. Data retention period

We retain your data for the period necessary to achieve the purposes for which it was collected:

— contact form data: up to 12 months from the last contact, or until cooperation begins, — data relating to performance of a contract: for the term of the contract plus 5 years (archiving obligations), — data required by tax and accounting rules: 5 years from the end of the tax year, — data processed on the basis of consent: until consent is withdrawn.

5. Data recipients

Your personal data may be disclosed only to:

— providers of IT and hosting services (including the contact form provider), — providers of accounting and legal services to the firm, — public authorities (the Polish Patent Office, EUIPO, WIPO) — solely to the extent necessary to provide the services, — foreign partner IP firms — solely with your consent or in performance of a contract.

We do not sell, rent or share personal data with third parties for marketing purposes.

6. Your rights

Under the GDPR you have the following rights:

— the right of access to your data (Article 15 GDPR), — the right to rectification (Article 16 GDPR), — the right to erasure, the "right to be forgotten" (Article 17 GDPR), — the right to restriction of processing (Article 18 GDPR), — the right to data portability (Article 20 GDPR), — the right to object to processing (Article 21 GDPR), — the right to withdraw consent at any time (without affecting the lawfulness of processing before withdrawal).

Given the global nature of intellectual property services, in some cases your data may be transferred to countries outside the European Economic Area — for example in the course of proceedings before the USPTO, JPO or CNIPA. Any transfer takes place solely to the extent necessary to provide the service and with the safeguards required by the GDPR.
