How do you protect FMCG product packaging?
Packaging can be registered as an industrial design with EUIPO, giving protection in 27 EU countries, or with the Polish Patent Office for Poland alone. A design protects appearance — shape, colours and graphics. In addition, the product name and logo are registered as a trademark. Together these two tools give full protection against copying.
We exhibit at the Poznań International Fair. How do we guard against copying?
It is best to file the trademark or industrial design before showing the product at the fair. In industrial property protection the filing date is decisive — it often determines priority. If you did not manage to file the appearance of a new product as an industrial design before disclosing it publicly, the case is not necessarily lost. In many instances you can still rely on the grace period and file within 12 months of the first disclosure.
We produce food for export. Do we need protection in every country?
Not separately in each. An EU trademark protects the brand in 27 countries at once for a single fee. For markets outside the EU — the United Kingdom, Switzerland or the USA, for example — we use the Madrid System, which extends protection through a single application. We match the scope to your export markets.
