We want to protect a food recipe. Patent or trade secret?

In practice, usually a trade secret. A patent requires full disclosure and lasts 20 years, after which the recipe becomes public. A recipe protected as a trade secret can be secured indefinitely, provided you implement appropriate procedures and employee agreements. The choice depends on how easily the solution can be reverse-engineered from the finished product.

We are a university spin-off. Where do we start?

By establishing who actually holds the rights. In university projects these are often split between the institution, the research team and the company, and an unresolved situation later blocks a funding round. We start with an audit, then tidy up the agreements, and only then file applications.

Is one trademark enough to sell across the EU?

Yes. An EU trademark covers 27 countries with a single application and a single fee. Markets outside the EU require separate filings, usually through the Madrid System. We match the scope to your actual export directions.
